Privacy and Cookies Policy

General Information

This Privacy and Cookies Policy of the website, hereinafter referred to as the Website, specifies the rules for the processing and protection of personal data, as well as the use of cookies and other technologies such as Google Analytics and Facebook Pixel in connection with the use of the Website and the fanpage by Users, and also with their use of services offered in the Shop available on the Website.

§ 1 Definitions

For the purposes of this privacy policy, the following meanings are assigned to the terms below:

  • Shop – the online shop available at: www.modelina-home.com

  • Website – the service available at www.modelina-home.com/blog/ and the fanpage at: https://www.facebook.com/modelinahome/

  • User – any entity browsing the content of the Website.

  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

§ 2 Personal Data

  1. The administrator of the User's personal data within the meaning of the GDPR is the Administrator.

  2. The User may provide their personal data to the Administrator using forms available on the Website, as well as via solutions such as Messenger, fanpage, etc.

  3. Personal data of Users are processed on various legal bases, depending on the purpose and nature of the User's contact with the Administrator. In particular:

  • [ORDER FORM] Personal data provided to the Administrator by the User as part of the order form are processed for the purpose of executing the sales contract (Art. 6(1)(b) GDPR), fulfilling legal obligations encumbering the Administrator, e.g., issuing an invoice and maintaining accounting documentation (Art. 6(1)(c) GDPR), and for the purpose of establishing, pursuing, or defending against claims, which constitutes a legitimate interest (Art. 6(1)(f) GDPR). Providing personal data by the User is voluntary but necessary for the User to conclude a contract with the Administrator.

  • [NEWSLETTER SUBSCRIPTION FORM] Personal data provided to the Administrator by the User as part of the newsletter subscription form are processed for the purpose of sending the User a newsletter containing information about new products and selected offers. Providing personal data by the User is voluntary but necessary for the User to subscribe and receive the newsletter. Processing of data for this purpose takes place solely based on the User's consent (Art. 6(1)(a) GDPR), which the User may express in the newsletter subscription form and may withdraw at any time. This data will be processed until the newsletter distribution is ceased or until the User withdraws their consent.

  • [COMMENT FORM] Personal data provided to the Administrator by the User as part of the comment form are processed for the purpose of displaying the comment. Providing personal data by the User is voluntary but necessary for the User to post a comment. Data processing for this purpose is based on the User's consent (Art. 6(1)(a) GDPR). This data will be processed for as long as the Website exists or until the User withdraws their consent.

  1. The Administrator may entrust personal data to other entities with whose help the goals specified in the previous points are achieved (e.g., companies providing hosting services, accounting firm, courier companies).

  2. The User's personal data will not be transferred to recipients from third countries or international organizations that do not provide an adequate level of protection. An adequate level of protection must be confirmed by an appropriate decision of the European Commission or another binding legal instrument.

  3. The Administrator guarantees the confidentiality of all personal data provided to them.

  4. Personal data are collected with due diligence and properly protected against access by unauthorized persons, and their processing takes place in accordance with and under the conditions specified in detail in the GDPR, the Polish Act of 18 July 2002 on the Provision of Electronic Services, and the Polish Act of 10 May 2018 on the Protection of Personal Data.

§ 3 User Rights

  1. The User is entitled to rights related to the processing of their personal data, including:

  • the right to access data,

  • the right to rectify data,

  • the right to restrict data processing,

  • the right to object to data processing,

  • the right to erase data (the right to be forgotten),

  • the right to data portability,

  • the right to lodge a complaint with the supervisory authority (President of the Personal Data Protection Office – PUODO) in connection with the processing of personal data by the Administrator.

  1. The User has the right to withdraw their consent at any time, provided that the User previously expressed such consent.

§ 4 Collected Information and Cookies

  1. While the User is using the Website, data concerning the User are automatically collected. This data includes, among others: IP address, domain name, browser type, and operating system type. This data may be collected by cookies or recorded in server logs.

  2. Cookies are small text files sent to the User's computer or another device (e.g., laptop, smartphone, tablet) and saved there while browsing the Website. Cookies remember User preferences, which allows for improving the quality of provided services, enhancing search results, increasing the relevance of displayed information, and anonymously tracking User preferences.

  3. The User consents to the installation and use of cookies (in particular analytical and marketing cookies) via the cookie management tool (the cookie banner) displayed during their first visit to the Website. Cookies necessary for the proper functioning of the Website are installed automatically.

  4. The User has the option to change their cookie preferences at any time via the tool mentioned in point 3 or by changing the settings of their web browser.

  5. The User may opt out of cookies by selecting the appropriate settings in the web browser they use. In such a situation, the User's use of the Website may be limited or impaired (e.g., the website may load slower).

  6. The User can delete existing cookies from their device using the appropriate functions of the web browser, dedicated software, or by using appropriate tools available within the operating system used by the User.

  7. Using the Website involves sending queries to the server where the Website is stored. Each such query is recorded in the server logs. Logs include, among others: the User's IP address, the date and time of logging into the server, and information about the web browser and operating system used.

  8. Data saved in the server logs are not combined in any way with specific Users of the Website and are not used by the Administrator to identify the User. Server logs are used to administer the Website, and their content is not disclosed to anyone except persons authorized to administer the server.

  9. Technologies that record activities undertaken by the User while using the Website are applied on the Website (subject to the User's prior consent expressed in the cookie banner). These include:

  • Google Analytics – used to analyze Website statistics,

  • Facebook Pixel – used to manage and optimize advertising on Facebook.

  1. Data obtained through the tools listed in point 9 are anonymized and do not serve the Administrator to identify the User's identity, but are used solely for statistical purposes and to optimize the product offerings in the Shop.

§ 5 Purpose of Data Use

The data provided by the User or collected automatically are used by the Administrator for the purposes of:

  • proper functioning, configuration, and security of the Website,

  • monitoring the session status,

  • analysis, research, and auditing of Website views,

  • execution of contracts concluded via the Website (execution of orders placed in the Shop),

  • as well as for statistical and marketing purposes.

§ 6 Final Provisions

  1. Changes may occur in this document, which may be influenced by the development of internet technology, changes in the law regarding personal data protection, and the development of our Website and Shop. Any changes will be communicated to Users immediately in a visible and understandable manner.
